    As entertainment, this video was bemusing. As a legal lesson it was useful and educational. As a legitimate comparison of a feif trial and US law, it was abysmal. Very good learning opportunity though.

    Objection Medievil law was vastly less just than today especially in The United States as we became a nation over 100 years after the reiniciance ended . Also Game of Thrones seems to be set in a world where the Magna Carta is not entirely applicable . He likely would not have been given a trial at all. Being of Nobillity himself he would not have been charged with any crime . instead a war would have been declared and Tyrion would have likely been Ransomed . Also the local Regent would be the "judge" given the era in question.The Era he would have been restrained if a trial however unlikely a trial would be. it would not usually have a jury as that duty would fall upon the local Regent. His accusation would have had him questioned and likely exiled or executed immediately. based on the judgment of whomever was in to be the Judge of said case. my rights as an American do not apply to Tyrion as he is not an American Citizen. if he was accused by the royal court he would have been found guilty if the regent did not like him. Regardless of Evidence. Trial by Combat was totally a thing. Even the Romans did it (gladiatorial arena ' The Germanic tribes and most Pre Christian Europe. Him Requesting Trial by Combat was totally a right during that era. Especially being a Noble. He likely not have even been a suspect. He could simply accuse or claim it was another and be sent home. Being royal he could say it was anyone and the Royal court would have had no choice but to peruse whomever was not him . All thogh mush of it depends on his accuser in which would be the person whom he would likely meet in the dueling grounds or the Champion they chose. Being Royal he could either choose a champion of fight his accuser (or their fighter of choice ) to whatever term decided by the local regent

    I know it's just for fun but in medieval times trials were very far of what they are today, so it doesn't make sense to compare it to modern trials

    My name is Crystal McCray of the clan MacRae out of Scotland and Falkirk my titles are Duchess of night Duchess of rain and yes you can order within the court trial by combat but you have to be a knight in order to do so as far as I know Tyrion was not a knight he was hand of the king so by Royal Decree he would not be able to demand trial by combat

    6:00 I have to take issue with his analysis. With hearsay there can often be an overlap between exceptions and what is or is not considered to be hearsay. Much of what was described is actually non-assertive conduct and is not hearsay at all. Putting that aside for the moment, the truth of the matter asserted was that Joffrey was a "vicious idiot" etc. etc. The court doesn't care if he was an idiot or if he was vicious. Thus, the statements are clearly not being offered for the truth of the matter asserted. But I think the truly dispositive evidentiary view is that these statements and actions show the then existing state of mind of the accused and are probative of a motive, intent and whether or not there was a plan to commit murder. This probably would not fall under the admission exception because the statements were not made in connection with the instant offense, but that is really academic based on the foregoing analysis. This fellow is very nice, but I would be surprised if he has ever tried a criminal case based upon his analysis. Based on the fact that there is no prosecutor and all of the witnesses testified in the narrative form, I think it is clear that this was meant to be a show trial.

    Here's the thing though, is it even fair to grade this scene using real life standards? I haven't watched Game of Thrones, but I would ASSUME things like constitutional rights and amendment rights would not apply here as they probably don't even exist. Or at least not in the same way that they do for us. In a medieval time period like this, I can't help but feel like this is exactly how things would/could play out....

    OBJECTION: Game of Thrones takes place in the BC years in it's own "universe". Not every country - or even every state (think the whole thing about photography being prohibited in a courtroom) - has the same courts laws. I'm actually kind of surprised Tyrion got a trial at all. I mean, Geoffrey had someone's tongue ripped out on the spot because he didn't like their song - no trial was deemed necessary.

    The trial of Tyrion Lannister is meant to be both a show trial and a kangaroo court. The parties involved all have vested interests in seeing Tyrion executed for Joffrey's murder. The closest thing to a kangaroo court that I can think of in American history would be the Salem Witch Trials (which occurred almost a full century before the US was a thing), but many show trials have occurred in the US in more recent years. It probably would have been better to compare the trial of Tyrion Lannister with some of that history, rather than with typical modern US jurisprudence. Especially since this is clearly a fantasy world where documents like the Magna Carta or ideas like habeas corpus don't exist.

    I'd like to see an English barrister analyze this scene - as the initial concept for the book series (and therefore the show) was based on England during the War of the Roses. This would suggest that the courts/judicial system (or lack thereof really) should be an analogue to that of England's during the period.

    Objection: I understand that your comparison of his trial is based on the knowledge that you have has a lawyer of New York of the 20th century. However, how can you give this trial a D- for realistic accuracy, without doing research and comparing proceedings and trial conductivity of the 15th century instead of today's methods. They neither have the same laws or constitution that we have today.
